Chapter 2 Regulation of timeshare schemes – Parliament
1. 2.1 The introduction of a new management structure anduniform compliance regime for managed investment schemes was intended to reduceinstitution risk and enhance consumer protection. The regime was put in place toimprove the international competitiveness of the Australian financial servicesindustry. 2.2 Timeshare operators assert that the regulatoryframework imposed under the Corporations Act has erected unnecessary andexpensive administrative hurdles for industry. Further, it is argued that theregime has the effect of decreasing the international competitiveness of thetimeshare industry without improving consumer protection. 2.3 This chapter provides a context for consideration ofthe issues raised by the timeshare operators and other evidence to the inquiry.It begins with a definition and brief overview of the timeshare industry beforesetting out the main features of the regulatory arrangements which currently governtimeshare schemes.
