1. Ave Maria School of Law. With a high acceptance rate and average student to faculty ratio, Ave Maria School of Law must make up for slack somewhere. However, it isn’t in the area of bar passage (only 53%) or high-scoring LSATs.
2. Boston University. Here is another law school with a great library which ranks #12 in the nation. But as for whether it’s a good school or not is up for debate.
3. Albany Law School of Union University. This school, on the other hand, has a well-stocked law library and ranks number twenty-five in that particular area.
4. Belmont University. Based in Nashville, Belmont University is number #25 on the bar passage list, with nearly 93% of their graduates passing the difficult test.
5. California Western. With a student/faculty ratio of 9.5:1 and a tuition that is scary-high for what they have to offer and the numbers they present, California Western hops on the list pretty easily.
6. Arizona Summit Law School (formerly the Phoenix School of Law) Called the Arizona Summit Law School since 2013, this law school has the displeasure of admitting that forty-one students failed out of their program last year, while thirty-five of them left by transferring out, and twenty discontinued for several other reasons.
7. Capital University. When it comes to GPAs and SATs, as well as bar passage statistics, Capital actually comes in fairly high. The problem is when their numbers are compared to every other law school in the country; they simply fall short.
8. Brooklyn Law School. This school, according to Top Law Schools has one of the absolute worst curves imaginable, and that after being changed recently.
9. Catholic U of America (Columbus) Catholic U makes the list due to several factors, one of which is a slightly-below-average post-grad employment rate.
10. Barry University. This Orlando, Florida law school ranks #145 when it comes to selecting their students, according to Public Legal. They accept around 57% of their applicants.

1980s remains unrebutted: punishing excessively low prices is paradoxical because the very objective of the antitrust laws is to secure low prices for consumers. As more and more cases of alleged predatory pricing are filed and new theories of liability based on price discounting gain popularity, the risk grows that predatory pricing law will result in higher prices to consumers …

Recognizing that data on marginal cost may be unavailable, the AMR court said the average variable cost test is “[a] commonly accepted proxy for marginal cost in predatory pricing cases.” 32 This comparison likewise makes sense as a one-sided test because if price is less than average variable cost, then in the short run, the firm is better off shutting down production …

Frequently Asked Questions

What is predatory pricing and is it illegal?

Predatory pricing is considered anti-competitive in many jurisdictions and is illegal under some competition laws. However, it can be difficult to prove that prices dropped because of deliberate predatory pricing, rather than legitimate price competition. In any case, competitors may be driven out of the market before the case is ever heard.

Is the free market the best way to stop predatory pricing?

That is used as evidence that the free market is a better way to stop predatory pricing than regulations such as anti-trust laws. In another example of a successful defense against predatory pricing, a price war emerged between the New York Central Railroad (NYCR) and the Erie Railroad.

What is the economic theory of predatory pricing?

The economic theory of predatory pricing simply states that companies choose to make less profitable pricing in the short term, but it does not explicitly state that profits must be negative. In anti-monopoly law enforcement, how to determine what level of pricing is predatory pricing becomes a problem in operation.

Does antitrust law prohibit predatory pricing?

However, because the antitrust laws are ultimately intended to benefit consumers, and discounting results in at least short-term net benefit to consumers, the U.S. Supreme Court has set high hurdles to antitrust claims based on a predatory pricing theory.
