Disability Legislation: State Laws May be Tougher than

1. Under the California Fair Employment and Housing Act (FEHA), the standard for measuring a disability is based on whether it makes a major life activity "difficult." Sounds clear, right? Not exactly. This contrasts with federal law stipulating that a condition must substantially limit one or more major life activities. But wait, there’s more. California law also specifically mentions certain diseases and/or conditions — such as HIV/AIDS, hepatitis, diabetes, bi-polar disorder, and heart disease — that are covered under the state regulation, whether or not these conditions are chronic or episodic. Then there’s the money issue. Specifically, a maximum payment. Unlike ADA, California law has no cap on the amount of punitive damages that can be awarded to a plaintiff in an employment or other discrimination case. California law also stipulates that mitigating factors — such as medication or assistive devices like eyeglasses, hearing aids or artificial limbs — not be taken into account wh...

Laws Impacting Disability Services in Higher Education

1. This law was the first anti-discrimination law for persons with disabilities. The law prohibited discrimination in any program or activity receiving federal funds of $2,500 or more per year. Financial assistance may be in the form of grants, contracts, or general assistance. Such organizations are required to make reasonable modifications in settings and facilities to increase accessibility to persons with disabilities. These organizations are required to follow nondiscrimination policies for workers and participants with disabilities. Since most universities (both public and private) receive federal funds through grants and other contracts, universities have been required to follow the legislative mandates for over 25 years. Although there are several sections to the 1973 Rehabilitation Act, the primary section particularly relevant to postsecondary settings is Section 504 which focuses on providing equal opportunity to qualified persons with disabilities.

1. Historically, some individual American states passed laws that required at least some degree of physical accessibility under building regulations and construction codes that predate federal efforts on the same subject. Some of the oldest federal laws related to disability tended to address specific needs or particular subgroups of people with disability, such as vocational rehabilitation for veterans with disabilities or old-age benefits for blind persons. These new laws had a broader cross-disability application because people with all kinds of disabilities faced common barriers of discrimination, prejudice, and stereotype which manifested themselves not only in physical inaccessibility, but in rigid social and cultural ways of doing things that prevented equal participation from people with disabilities. The ground-breaking concepts of "reasonable acc...
