8 Steps in Every Personal Injury (Civil) Lawsuit: What to

1. Summons and complaint. The first document filed in most personal injury lawsuits is called the “complaint.” The filing of the complaint effectively begins the lawsuit.
2. Answer. Once the complaint and summons are filed and served, the defendant must respond in a certain amount of time. This varies depending on the court (and sometimes the location of the defendant), but is usually around 21 days.
3. Discovery. Once the initial pleadings (complaint, summons, answer, counterclaim, etc.) have been filed, the parties begin the process of obtaining evidence from each other.
4. Motions. Before the trial begins, parties may use motions to ask the court to rule or act. If a ruling on a motion could result in a termination of the lawsuit, it’s called a “dispositive motion.”
5. Pre-trial negotiations. Trials are expensive, time-consuming, and emotionally draining. As a result, good lawyers will try to resolve a case before it gets to trial.
6. Trial. In a civil trial, a judge or jury examines the evidence and decides whether the defendant should be held legally responsible for the damages alleged by the plaintiff.
7. Collecting the judgment. Congratulations! The judge or jury has awarded you money damages. Unfortunately, the defendant (now the “debtor”) doesn’t always follow the court order and pay the amount of the judgment.
8. Appeal. If a party doesn’t agree with the result of the trial, they can appeal the decision. If a decision is appealed, each party will have an opportunity to submit a brief to the appellate court.

The Five Steps in a Personal Injury Lawsuit

6 hours ago A STEP BY STEP LOOK AT THE PERSONAL INJURY LAWSUIT PROCESS

Estimated Reading Time: 9 mins
1. Consult an Attorney. As soon as possible after your injury, whether you suffer broken bones, soft tissue damage, or traumatic brain injury, consult with an attorney.
2. Investigating the Accident. To accurately assess the parties responsible for your accident, your attorney will need to fully understand the accident.
3. Issuing a Claim for Compensation. Once your attorney has heard your version of events and collected any evidence related to your accident, he will work with you to file a demand for compensation with the responsible insurance companies.
4. Negotiation. Often, once you file your claim, the insurance company will immediately reply with a settlement offer. Sometimes, the insurance company may even issue a fast settlement offer before you have a chance to discuss your claim with an attorney or even fully understand the expenses you face as a result of your injuries.
5. Taking Your Claim to Court. If you cannot reach an agreement with the insurance company, you will need to create a court case. This includes several phases.

What Are the Stages of a Personal Injury Lawsuit? AllLaw

Estimated Reading Time: 7 mins
1. The Plaintiff Is Injured and (Usually) Hires an Attorney. At the heart of any legitimate personal injury case is, of course, an injury of some kind. However uncertain the defendant's liability or the extent of the plaintiff's losses might be, no case will make it far without some proof of the plaintiff's injury.
2. A Complaint Is Filed and Served on the Defendant. After establishing that a legitimate case exists, the plaintiff's attorney will file a personal injury complaint in the proper civil court.
3. The Defendant Hires an Attorney. The defendant will typically have a month or more to find an attorney before his or her first court date. If the defendant has assets or an applicable insurance policy, finding a personal injury defense attorney willing to take on the case should not prove difficult.
4. Pre-Trial and "Discovery" In the pre-trial process, both sides will ask each other for evidence and witness information in a phase called "discovery." At the early stages, both sides will also appear in court to inform the judge of how the case is proceeding, to agree (or not agree) to mediation or arbitration, and to set a trial date.
5. The Trial Phase of a Personal Injury Lawsuit. Finally, the trial will begin and, for a typical personal injury case, last at least several days. At trial, the judge or jury will determine if the defendant is at fault for the accident and for the plaintiff's losses, and if so, how much the defendant is required to pay out in damages.
6. Settlement Is the Most Likely Outcome. Most personal injury cases settle before trial. At any point in the process described above, the parties can settle and end the case, even before the complaint is filed.

What is the Personal Injury Claim Process? Nolo

1. Get Medical Treatment. The first thing that you should do after getting injured in an accident is get medical treatment. That means, if you have even the slightest sense that you are hurt, go to the emergency room or make an appointment see your doctor.
2. Consult a Personal Injury Lawyer. For anything more than a very minor claim, it's usually a good idea to at least discuss your situation with a personal injury lawyer.
3. Lawyer Investigates Claim and Reviews Medical Records. One of the first things your lawyer will do is interview you. The lawyer wants to know everything you know about the accident, your injuries, and your medical treatment.
4. Lawyer Considers Making Demand and Negotiating. Many smaller personal injury claims are settled before a lawsuit is ever filed. If the lawyer thinks that the case can be settled, they will make a demand to the other attorney or the other side's insurance company.
5. The Personal Injury Lawsuit is Filed. The litigation phase starts when you and your lawyer file a personal injury lawsuit in court. The filing of the lawsuit starts the clock running on when the case might get to trial.
6. The Discovery Phase of a Personal Injury Case. The discovery phase is when each party investigates what the other side's legal claims and defenses are. They send interrogatories (a fancy word for questions) and document requests to each other, and take depositions of all relevant parties and witnesses, generally beginning with the plaintiff and defendant.
7. Mediation and Negotiation. As the discovery period ends, the lawyers will generally start talking settlement. Sometimes the lawyers can settle just by talking among themselves, but, in other cases, they will go to mediation, a process in which both clients and both lawyers get help from a neutral third party mediator to try to resolve the case.
8. Trial. Mediation often works, but if it doesn't, the case is scheduled for trial. A personal injury trial can last a day, a week, or even longer. The length may be increased because, in many states, trials are held for only half a day instead of over a full day.

PreSettlement Lawsuit Funding in Personal Injury Cases

21.086.417Just Now

1. Pre-settlement advances are offered as non-recourse funding, which means that an injured person has no obligation to repay if the lawsuit is lost. If the ultimate settlement or verdict is smaller than anticipated, the amount that must be repaid by the plaintiff never exceeds the amount of the injured person's share of that verdict or settlement. The process by which a plaintiff may receive pre-settlement funding for a pending personal injury case is as follows: 1. An injured person contacts a company that offers pre-settlement lawsuit funding, sometimes at the suggestion of an attorney. 2. The finance company contacts the lawyer who is handling the case, and obtains information about the case. 3. Based upon that information provided, the finance company estimates the value of the likely eventual settlement or verdict, and offers a cash advance to the injured person based upon that estimate. 4. The finance company's fee for providing the advance may be a flat fee, or a monthly fee th...

What Happens During a Personal Injury Lawsuit Ashton

21.086.4177 hours ago

1. Every lawsuit involves a plaintiff and a defendant. The plaintiff is the person or persons who file a lawsuit against somebody. The person who is allegedly responsible for the plaintiff’s suffering is the defendant. There can be more than one plaintiff and/or defendant. When you are filing a personal injury lawsuit against the defendant—the driver of a car who injured you, the owner of a dog that attacked you, the owner of property on which you were injured—the first step is letting the defendant know that you are filing suit against them. Usually, this is done by sending them two legal documents: 1. Complaint – A complaint is a legal document that describes why you are filing a lawsuit against them. It’s essentially a brief description of what the defendant did wrong that hurt you or your loved ones. It will also include a prayer for relief, which simply means how much money you want from the defendant. 2. Summons – A summons describes who you (the plaintiff) are, what court the su...
