Legislation – Queensland Law Handbook Online

21.086.4176 hours ago

1. An Act is not the only type of legislation. Other types of laws are made to regulate administrative procedures and other matters not dealt with by an Act of parliament. Rules, by-laws and public ordinances are made by public authorities, local councils, government ministers and public servants to complement specific Acts. The power to make these laws is delegated (given) by parliament and conferred by the Act (often called a parent Act), so that rules, by-laws and public ordinances are often collectively known as delegated legislation. Rules, by-laws and public ordinances must be worded so they do not go beyond the boundaries laid down by the Act under which they are made. A regulation that attempts to regulate matters outside the scope of its parent Act can be declared by a court to be of no effect.

21.086.4174 hours ago

1. Over the last three decades in Australia mediation has grown inpopularity as a constructive, negotiation-based, facilitated, informaldisputeresolution process. This growth indicates an increasing awareness of the realbenefits of mediation as a positive disputeresolution forum, and a greaterappreciation of its potential. As the use ofmediation has developed and the number of mediators has grown, the practice ofmediation has turned from what was anarguably adjunct multidisciplinaryindustry to a respected dispute resolution profession in its own right. Whilstthe professionremains unregulated and is still grappling with approaches toissues such as accreditation and professionalstandards, the practice of theprocess of mediation itself has become increasingly sophisticated.
