1. General. Section 1151 of Title 30 of the Delaware Code requires every employer who; maintains an office or transacts business within Delaware, and.
2. Definition of Employers. An employer is any person or organization for whom an individual performs any services as an employee. It includes any person or organization paying wages to a former employee after termination of his employment.
3. Duties of Employers. (a) Registering to Withhold Income Taxes. (b) Request for Forms. (c) Hiring New Employees – Form W-4,W-4A, or SD/W4A. (d) Reporting New Hires.
4. Employer Identification Number. Your Federal employer identification number must appear on all forms, attachments, and correspondence you send to the Division of Revenue along with an appropriate phone number.
5. Depositing Taxes. (a) Monthly. (b) Quarterly. (c) Eighth Monthly. (d) Lockbox Processing. Every employer required to deduct and withhold taxes on a monthly basis shall for each calendar month on or before the 15 of the month following the end of such calendar month, file Form W-1 withholding return, and pay to the Division of Revenue, or a designated depository, the taxes so required to be deducted and withheld.
6. Electronic Filing Programs. (a) Mandatory Electronic Funds Transfer Program. (b) Business Internet Filing Program.
7. Employer's Liability for Withheld Taxes. Every employer required to deduct and withhold tax is liable for such tax. For purposes of assessment and collection, any amount required to be withheld and paid over to the Division of Revenue, any additions of tax, penalties and interest with respect thereto, shall be considered the tax of the employer.
8. Definition of Employees. (a) General. (b) Household Employees. (c) Employers of Farmworkers. (d) Crew Leaders. Everyone who performs services subject to the will and control of an employer both as to what shall be done and how it shall be done is an employee.
