Reform of family law – Parliament of Australia

21.086.4178 hours ago

1. The Family Law Act 1975(FLA), which came into force on 5 January 1976, was premised on the need to reform divorce law to eliminate fault, simplify procedures and reduce cost. It contained two significant reforms that changed the approach to marriage breakdown in Australia: the introduction of no-fault divorce, and the establishment of a specialist, multi-disciplinary court for the resolution of family disputes–the Family Court of Australia (FamCA). The FLA had a lengthy genesis with considerable parliamentary debate and scrutiny that reflected the tension between the divorce and reconciliation provisions. It was controversial and revolutionary at the time, as it was seen by some to be attacking the institution of marriage. However, there was also pressure for significant social change coupled with distaste with the existing, fault-based divorce procedures. The FLAintroduced a single ground for divorce—the irretrievable breakdown of marriage. This was demonstrated by a 12 month separ...

Australian family law system Family law information

21.086.4175 hours ago

1. The original 1975 FLA revolutionised the divorce law of Australia by establishing a ‘no-fault divorce’ clause, removing the requirement for a couple to prove that one of the parties had caused the breakdown of the marriage. This clause was introduced to reduce the complex, stressful and hostile nature of divorce proceedings and to increase the chances of alternative dispute resolution. Consequently, the only ground for divorce in Australia is the irretrievable breakdown of the relationship’, which must be demonstrated by showing the parties have separated for 12 months prior to filing for the divorce application. The FLA also reduced the time for a decree nisi for a divorce to take effect from three months to one month. See more information on divorce in Australia

Family law Magistrates Court of Victoria

1. A parenting order is a set of orders made by a court about parenting arrangements for a child. The Magistrates’ Court can make a parenting order based on an agreement between parties. These are called consent orders. Where parties can’t agree, the court can make an interim parenting order. The matter will then go to the Federal Circuit Court of Australia for a final decision. When making a parenting order, the court will consider the best interests of the child. Parenting orders can outline: 1. who the child lives with 2. how much time the child will spend with each parent and their families 3. how the child will communicate with a parent they do not live with 4. information about the welfare or development of the child. A recovery order can also be made if a child has been taken or not returned as set out by a parenting order. A recovery order can require the return of the child or authorise the police to recover the child.
