1. There are two types of trading programs currently used in the United States: Emission Reduction Credits (ERCs) and Capped allowance systems (i.e. cap-and-trade). 1. Emission Reduction Credits (ERCs): ERCs are uncapped trading systems, meaning there is no set limit on the maximum allowable level of pollution within a regulated area. Instead, pollution limits are rate-based, meaning polluters cannot exceed a rate of emissions (e.g. grams per mile for motor vehicles). Polluters earn credits by r...
2. Fees, charges, and taxes are widely used incentives which generally place a per unit monetary charge (or fee or tax) on pollution emissions or waste to reduce the overall quantity. The main drawback is that fees, charges and taxes cannot guarantee a specific amount of pollution reduction, only that those who pollute will be penalized. Examples include pollution taxes, water user fees, wastewater discharge fees, and solid waste disposal fees. Top of Page

What is Environmental Law? Becoming an Environmental Lawyer

21.086.4174 hours ago

1. Environmental laws are relatively new in American history. Lawmakers began to pass environmental laws in the twentieth century. The environmental movement began to pick up pace in the 1960s with the majority of environmental laws and regulations being created since that time. The first environmental laws focused on nuisance. When one person’s use of their property interferes with another person’s use of their own property, courts can step in to stop the nuisance. Nuisance laws largely developed through common law decisions in the courts. The laws protect a property owner from having another person or corporation infringe on their right to enjoy their own property. Early environmental laws didn’t focus on protecting the environment as a whole. They also didn’t give standing for a person to sue a polluter if they weren’t personally harmed by the other person’s actions.

Environmental Policy for Developing Countries Issues in

1. Although incentive-based approaches to environmental control were being developed by economists in the early 1970s when many of the basic environmental laws were being written in the United States, none of the early laws used economic instruments. Market-based tools began to make inroads in the 1980s when regulators at the U.S. Environmental Protection Agency (EPA) saw that they could be useful in dealing with difficult Clean Air Act implementation problems. Each stack at each regulated facility had been given a discharge permit. The EPA innovation allowed firms to trade those permits internally and externally, so that expensive-to-control sources could emit more and cheap-to-control sources would be encouraged to cut back. A variation of this system was eventually written into law to create the best-known and most successful U.S. market-based instrument. To control acid rain, Title IV of the 1990 Amendments to the Clean Air Act established tradable emission allowances for sulfur di...
