Delaware law prohibits an employer from discriminating and retaliating against employees in a variety of protected classes. Equal Pay. Delaware's Wage Payment and Collection Act prohibits an employer from paying an employee a lower wage than the wage paid to an employee of the opposite sex in the same establishment for equal work on a job requiring equal skill, effort and responsibility, and that is performed under similar working conditions.
