1. Contractual terms are everywhere within the social media landscape and, while these terms generally are benign, occasionally such terms can have significant bite. Contractual provisions will usually surface in the form of terms of use, privacy policies or community use guidelines, among others, and these contracts may be implemented by a traditional licensing agreement or services contract for use of the application or, more commonly, through an online click-wrap agreement. Although social media tools are deployed in many organizations so as to allow widespread, decentralized access, agreeing to overall usage terms on behalf of an organization should be reserved to a specific point of contact or function within that organization. Otherwise, a company may find itself unknowingly or inappropriately bound to terms that commit it to obligations or the granting of rights that the company may later regret. Consider, for example, some customary provisions found in the online terms of a few...

7 Ways to Minimize Legal Issues in Social Media Marketing

1. The difference between LINKING and SCRAPING. The absolute safest course of action is to create your own original content, from the copy on your website to the videos you post to YouTube and the images you upload to Pinterest.
2. Go the extra step and get permission. Without permission, using someone else’s content is infringement. With permission, it’s free publicity for them, great content for you.
3. Use content that’s licensed under Creative Commons. If you’ve encountered writer’s block and can’t get permission for any suitable content that someone else has created, consider using content released pursuant to a Creative Commons license.
4. Choose an original name. You can save yourself headaches right out of the gate by choosing a unique name for your company, blog, brand or product. This is why we see so many crazy names on the web like ZipperFish and Stagnant Ape (kidding).
5. Don’t play games with games. Having online games or competitions can be tricky because you can’t violate the law when conducting an online contest, giveaway or sweepstakes.
6. Be honest (It’s the law!) Be accurate in any statements you publish via social media. Lying about competitors or their products can get you sued for defamation or interference with contractual relations.
7. Use tools like Hootsuite with caution. I’m a huge fan of social media management tools like Hootsuite, Seesmic, and TweetDeck that enable you to populate numerous social network feeds from a single application.

Top 5 Legal Issues in Social Media Legal Reader

1. Copyright Infringement. Thanks to the rise in user-generated content, it’s impossible to talk about legal issues related to digital content without mentioning copyright infringement.
2. Defamation. It’s one thing smearing a colleague or a business rival behind closed doors with unfounded rumors, but it’s another to do it on social media platforms.
3. Formatting of Sponsorship Posts. This is probably one of the newest legal issues in social media and it comes in the wake of the FTC’s (Federal Trade Commission) crackdown on online influencers.
4. Fake Testimonials. Testimonials are an excellent way to build trust between brands and consumers. And, as per the meaning of the term, “testimonial”, it’s supposed to be a third person’s account of their experience using the services provided by a brand.
5. Paying attention to terms and conditions on social media platforms. We are all guilty of not paying attention to the terms and conditions whenever signing up on a new platform, but it’s high time that changed, given the drastically changing rules of the use of online platforms.

Ethical Issues For Attorneys Using Social Media Southern

1. The first wave of the Internet, what might be called “Web 1.0”, was not so much a new form or communication, but rather a new media platform. For many it was simply another “place” to post information. When the first websites came out, they basically mimicked ads, brochures, newspapers, and even broadcast programs in style and content, only they were accessed through the Internet. Law firms, if they had websites, typically posted general information about the firm, its practice areas, and profiles of the key attorneys. Web 2.0 and social media is different is because actually changed the way we communicate via the Internet. Most importantly, what was one-way communication online has become two-way communications and conversations. Formerly companies, brands, media companies, and yes, law firms controlled the flow of information on their websites. Avoiding Legal and Ethical Problems on Social Media

1. The first pitfall most attorneys are likely to fall into is discussing their cases. Some attorneys get so comfortable with their social media presence they forget their audience may not be limited to the select few that respond to their posts or even those on their friends lists. Worse yet, the problem often begins innocently enough with a posting that says something like: "What a day in court! The other attorney is a [email protected]#%#*\" "Oh yeah! Just found the perfect case law. Going to show the other side how the Economic Loss Rule works tomorrow! Booya!" "I hate my new client. What a needy jerk!"
