10 Legal and Ethical Issues in the Workplace

1. Being Aware of New Trends. Life as a business owner may have been easier 100 years ago, but the conditions were pretty terrible for workers. While it might seem that new issues are cropping up all the time, they’re not really new – they’re just finally coming to light.
2. Ethics. As a business owner, you might think that the law tends to come down more favorably on the worker’s side, but that’s not true: you’re still in control.
3. Workplace Safety. Many of the legal issues we talk about are up for debate, and thus can be difficult to manage. This cannot be said of workplace safety, however, which is pretty clear when you get down to it.
4. Letting Employees Go. Nobody likes to fire an employee, but it simply has to happen from time to time. Before you let someone go, however, it’s important that you’re completely sure that you have the legal right to do so.
5. Keeping Employees Happy. It might feel like it’s easy to trip up legally with your employees, and that’s because it is. For example, one thing that most employers fail to realize is that they can be sued if they use an image of one of their employees in promotional materials for the business without their consent.
6. Social Media. How businesses handle the private social media activity of their employees is still being worked out. Because it’s such a relatively new issue, there aren’t really any set laws that deal solely with websites like Facebook or Twitter.
7. The Intern Problem. Hiring an intern for a set period of time can be a great arrangement for your business, but it’s easier than you’d think for you to fall foul of the law.
8. Time and Overtime Issues. There’s one issue that’s being debated right now that will have a massive effect on US businesses. In November, a Texas judge overruled a new law that would have made millions of employees eligible for overtime pay.
9. Discrimination in the Workplace. Unfortunately, it’s not just up to you to make sure your business is doing everything right legally. You also need to make sure that all your employees know what is permissible in the workplace and what isn’t.
10. Changes are Coming. It can seem that the workplace is a legal minefield, and it’s only going to get more complicated in the near future, as there’s going to be a whole host of new rulings rolling out on a state by state basis.

Ethics in Law for Business Encyclopedia.com Free

1. Law for business consists of a set of required norms of behavior. The essence of law is that it commands behavior under threat of punishment or sanction. Tax law requires the payment of money to the government; there is no choice. Contracts are entered into voluntarily, but once entered into they may be enforced through the courts. Many laws have no particular ethical content. Many laws require ethical behavior, and, in rare cases, some laws may require unethical behavior. Frequently the law allows the businessperson the choice to be either ethical or unethical. In those cases the question arises: Should the law require ethical behavior?

How to avoid 10 common ethics pitfalls ABA Journal

1. Problem: Understanding technology and protecting client data Arguably, a lawyer’s foremost duty is the duty of competency, outlined in Rule 1.1 of the ABA Model Rules of Professional Conduct. In 2012, Comment 8 to Rule 1.1 included the so-called technology clause, which provides: “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology.” In this age of hacking in a rapidly changing digital world, protecting client data and cybersecurity are among the key reasons lawyers must stay current on technology. “On the technology front … some lawyers remain relatively in the dark and risk breaching client confidentiality not only from a traditional cybersecurity breach but also from other ‘smaller’ misuses of technology,” says Jan Jacobowitz, an ethics expert who teaches at the University of Miami School of Law. She cites the examples of lawyers working on public W...
